On April 3, 2009, the Superintendant of FSCO released 39 recommendations to the Ontario government to address issues relating to Ontario’s car insurance regime. Some of the recommendations include reducing the deductibles on awards for pain and suffering made to accident victims and their families and eliminating the deductible on fatality claims. The Superintendant also recommends eliminating the regulation that defines “serious” and “permanent” . To be able to sue in Ontario for your pain and suffering after a car accident, you need to prove, among other things, that you have a serious and permanent injury. The regulation, from 2003, has created issues for certain segments of the population who face injury.
